1. Introduction

Welcome to Pixen Marketing ("Company", "we", "our", "us"). By using our AI-powered automation services (the "Services"), you ("Client", "User") agree to these Terms of Service. If you do not agree, please do not use the Services.

2. Description of Services

We provide business automation solutions powered by AI agents and LLMs, including automated content creation, workflow optimization, and data processing.

AI is probabilistic: Outputs may be inaccurate or incomplete. You are responsible for reviewing AI-generated text, code, and data before deployment.

3. Account Registration & Security

  • Provide accurate, current, and complete information when registering.
  • You are responsible for safeguarding credentials and all activity under your account.

4. Subscriptions and Payments

  • Pricing: Billed per selected tier (Monthly, Quarterly, Annual).
  • Payment Terms: Due in advance of each service period.
  • Renewals: Auto-renews unless cancelled at least 3 days before renewal.
  • Refunds: Fees are non-refundable due to compute and licensing costs.

5. Intellectual Property & Content Ownership

  • Your Input: You retain rights to data and materials you provide; you license us to use them to deliver and improve the Services for you.
  • AI Output: Upon full payment, you own the specific deliverables generated for you.
  • Our Technology: We retain rights to the platform, agents, workflows, prompts, and code.

6. User Obligations & Acceptable Use

You agree NOT to use the Services to:

  • Generate illegal, defamatory, hateful, or sexually explicit content.
  • Violate others' IP rights.
  • Reverse engineer, decompile, or attempt to extract source code or prompts.
  • Upload malware or malicious code.
  • Use the Services for spam or abusive automation.

7. Limitation of Liability

  • Services are provided "AS IS" and "AS AVAILABLE"; we do not guarantee accuracy of AI outputs.
  • No liability for indirect, incidental, or consequential damages.
  • Total liability is capped at fees paid in the three (3) months preceding the claim.

8. Confidentiality

We keep your proprietary information and Input Data confidential and do not sell it. Standard processing may use trusted third-party AI APIs (e.g., OpenAI, Anthropic) under their retention policies unless an Enterprise "Private Cloud" agreement states otherwise.

9. Termination

We may suspend or terminate access immediately for breaches (e.g., spam, illegal use, security risks). You may cancel per the renewal terms above.

10. Governing Law

These Terms are governed by the laws of Spain. Disputes are subject to the courts of Barcelona (or your local jurisdiction if separately agreed).
